Melty Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Stella Montis Inc. ("Stella Montis," "Melty," "we," "us," or "our"). They cover your use of Melty, including the website at melty.gg, the Melty desktop app, the tools Melty offers creators and their coding agents, and everything else we provide under the Melty name (together, the "Services").

By using the Services, creating an account, installing the Melty app, or publishing a mashup, you agree to these Terms. If you don't agree, don't use the Services and uninstall the Melty app.

1. What Melty is

Melty is a place to find, play and share mashups and mods for PC games. A "mashup" is a mod, a combination of games, or another change to a game that a creator publishes on Melty. Mashups are made by players and creators, not by Melty.

When you press Play, the Melty app sets up what the mashup needs on your PC and starts it. Creators publish mashups from the website, from their own coding agents through Melty's tools, or from a GitHub repository.

We may add, change, limit or stop any part of the Services at any time. Some features are experimental.

2. Who can use Melty

If you're under the age of majority where you live, you may use Melty only with a parent's or legal guardian's permission, and they are responsible for your use. You may not use Melty if the law, sanctions rules or a previous suspension by Melty bars you from doing so.

If you use Melty for a company or other organisation, you confirm that you can bind it to these Terms, and "you" includes it.

3. Your account

Some features need an account. Keep your sign-in details, and any tokens Melty gives you or your coding agent, private. You're responsible for what happens under your account, including what a coding agent publishes with your token. Tell us promptly if you think your account or a token has been compromised.

Your profile name and picture, what you're playing, and the mashups you publish can be seen by other people on Melty.

4. The Melty app on your PC

To play a mashup, the Melty app does things on your PC on your behalf. You agree to let it:

  • find the games installed on your PC and read their versions, so it can tell what you can play;
  • download the mashup's files and the tools it needs, such as mod loaders, launchers and build tools, from Melty or from the original authors' sources;
  • write files into your game folders and other folders a mashup needs, after keeping a copy of any file it replaces so it can put your game back as it was when you remove the mashup;
  • build parts a mashup needs on your PC, using tools it downloads into its own folder;
  • when a mashup is made to use your own copy of a game, look for that copy in your folders and drives and copy the files it needs into the mashup's folder;
  • start your games, the mashup's own programs and any setup step it needs; and
  • update itself automatically.

A mashup's own programs run on your PC with the same access as any other program you run. Melty doesn't review mashups before they go live and doesn't scan them for malware (see section 6).

Changing a game can break it, corrupt saves, or conflict with the game's rules, anti-cheat or online services, which can lead to a ban from that game. Use mashups at your own risk, and keep backups of anything you care about, such as saves.

You may install and use the Melty app for your own use under these Terms. Don't copy, sell or redistribute it, or get around its security, except where the law allows.

5. Your games

Mashups run on games you own. Melty doesn't sell, lend or license any game. You need your own legitimate copy of every game a mashup uses, and your own accounts for the services those games need (for example Steam or a Minecraft account). Your use of a game stays subject to its publisher's and store's terms, and Melty doesn't change your obligations to them.

6. Mashups made by others

Mashups are made by their creators. Melty doesn't check them for quality, safety, ownership or legality before they appear, and we don't endorse them. Melty runs automatic checks on uploads that refuse some kinds of dangerous files, but those checks look at file names and types, not at what files do, and they won't catch everything.

You use other people's mashups at your own risk. If something looks wrong, report it from its page.

7. Publishing mashups

You're responsible for everything you publish. That includes every file in a mashup, game files included, its name, pictures and description, and every release published under it, whether you publish it yourself, through a coding agent, or automatically from a GitHub repository you connected. Only publish what you have the right to share. Melty takes you at your word and doesn't check who owns what you upload.

By publishing, you confirm that you have every right, licence and permission needed to share the mashup, and to let Melty and players use it as these Terms describe, and that it doesn't break any law or anyone else's rights.

Licence to Melty. You keep whatever rights you have in what you publish. You give Melty a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, test, show, distribute and promote what you publish, and to set it up and run it on players' PCs, as needed to operate and improve the Services. This lasts while your mashup is on Melty, and for as long as needed afterwards for backups, records, disputes and legal obligations.

Licence to players. You let anyone who can reach your mashup on Melty download, install and play it for their own use through Melty. If you allow remixes, you also let other creators make and publish their own versions based on yours, credited to yours.

Going live. A release goes live once Melty has seen it running on your PC. We may keep a release from going live, or take it down, at any time.

Install reports. When players install or play your mashup, Melty records whether it worked, with short error details and the game version. You and your coding agent can see these reports to fix problems.

Coding agents. If you connect a coding agent to Melty, it acts for you. You're responsible for what it does with your account and token.

8. Playing together

Multiplayer mashups come with a join link. Anyone who has the link can join the game. If you make a game public, anyone on Melty can see it and join.

When you host a game, other players connect to your PC, either directly or through the game's own services. To make that work, Melty shares your game's network address (IP address and port) with the players who join that game. Melty doesn't run game servers, voice or chat.

You're responsible for how you behave in games and for who you invite. Hosts can remove players and anyone can block other players, but Melty can't control what happens inside a game once players are connected.

9. Things you may not do

You may not, or help anyone else to:

  • publish or share anything you don't have the right to share, or that infringes anyone's copyright, trademark, privacy or other rights;
  • publish malware, spyware, cryptominers, or anything built to harm players, their PCs, accounts or data, or to collect information without their knowledge;
  • hide what a mashup does, or misrepresent who made it or what games it needs;
  • publish anything illegal, sexually exploits minors, promotes violence or terrorism, or harasses, threatens or exposes another person;
  • use Melty to cheat in competitive online play against people who haven't agreed to it;
  • impersonate anyone, or abuse other players, including through multiplayer games or reports;
  • get around Melty's checks, limits, security or the publishing rules, or access anything you aren't allowed to;
  • disrupt, overload, scrape or attack the Services; or
  • sell, rent or give access to your account or tokens.

Anyone can report a mashup from its page. We may remove or disable any mashup, release or account that we believe breaks these Terms or the law, or puts players, Melty or others at risk, with or without notice.

Repeat infringers. If mashups you published are taken down for infringing others' rights more than a set number of times, you'll lose the ability to publish, and we may close your account.

Copyright notices. If you believe something on Melty infringes your copyright, send a notice to david@melty.gg. Include: the work you say is infringed; where it is on Melty (a link); your contact details; a statement that you believe in good faith the use isn't authorised by you, your agent or the law; a statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorised to act for them; and your physical or electronic signature. We'll take down material we're notified about where appropriate and tell the creator.

Counter-notices. If your mashup was taken down and you believe that was a mistake, you may send a counter-notice to the same contact with the details the law requires. We may restore the material unless the person who complained tells us they've started legal action.

11. Paid features

Melty is free to use, and all mashups are currently free. If we introduce paid mashups, tips or creator payouts, additional terms will apply to them, and payments will be handled by a payment provider under its own terms.

12. Other services

Melty works with services run by others, such as Steam, Discord, Google sign-in, GitHub, game publishers, launchers, mod loaders and the sources Melty downloads tools from. Those services have their own terms and privacy policies, and Melty isn't responsible for them, including their availability, decisions or enforcement.

13. Melty's rights

Melty, the Melty app and website, their software, design and the Melty name and logos belong to Stella Montis or its licensors. These Terms don't give you any right to them except to use the Services as described here. Don't use Melty's name or logos in a way that suggests we made or endorse your work.

If you send us feedback or ideas, we may use them freely without owing you anything.

14. Privacy

Our Privacy Policy explains what information we collect and how we use it.

15. Ending your use

You can stop using Melty at any time and uninstall the app. We may suspend, limit or close your account, or take down what you published, if we believe you broke these Terms or the law, or to protect players, Melty or others.

When your use ends, your licence to use the Services ends. Sections that by their nature should last, including those on responsibility, licences already granted for removal and records, disclaimers, liability, indemnity and disputes, continue to apply.

16. Disclaimers

The Services and all mashups are provided "as is" and "as available." To the fullest extent the law allows, Melty disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement.

Melty doesn't promise that a mashup will install, work, be safe or be legal to use; that the app will leave your games or saves unharmed; that you won't be banned from a game or online service; or that multiplayer games will connect or be free of bad behaviour.

17. Limitation of liability

To the fullest extent the law allows, Stella Montis and its affiliates, officers, employees, contractors, licensors and service providers won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, saves, profits, goodwill, or game or account bans, arising from or relating to the Services or any mashup, even if we were told they were possible.

To the fullest extent the law allows, our total liability for all claims relating to the Services or these Terms won't be more than the greater of $100 or the amount you paid Melty in the 12 months before the claim arose.

Some places don't allow some of these limits, so they may not all apply to you.

18. Indemnity

To the fullest extent the law allows, you'll defend and indemnify Stella Montis and its affiliates, officers, employees, contractors, licensors and service providers against claims, losses and costs, including reasonable lawyers' fees, arising from what you publish, your use of the Services, your games and multiplayer sessions you host, or your breaking these Terms, the law or anyone's rights.

19. Changes to these Terms

We may update these Terms. If a change is significant, we'll tell you, for example on melty.gg, in the app or by email, and update the date at the top. If you keep using Melty after a change takes effect, you accept the updated Terms.

20. Governing law and disputes

These Terms are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to conflict-of-law rules, unless the law where you live requires otherwise.

Before bringing a claim, you and Melty agree to try to resolve it informally: send the other side a written description of the dispute and allow 30 days to resolve it.

Except for small claims and claims for urgent relief about intellectual property, security or unauthorised access, disputes arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its rules, in Delaware unless agreed otherwise, and may be held by video, phone or in writing.

You and Melty may bring claims only individually, not as part of a class, collective or representative action, unless the law prohibits this waiver. If any part of this section can't be enforced, that part is removed and the rest stays in effect.

21. Everything else

These Terms, with any additional terms that apply to a feature, are the whole agreement between you and Melty about the Services. If a part can't be enforced, the rest still applies. Not enforcing a part isn't a waiver. You can't transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, reorganisation or sale of assets.

We aren't responsible for delays or failures caused by things beyond our reasonable control, including outages, failures of other services, game or platform changes, and natural or political events.
